Enforcement procedure

Are you not satisfied with the processing of your request? Or have you not received a response to your feedback within six weeks? In this case, you can submit an application to the monitoring body for digital accessibility of public bodies M-V for a review of the regulations and measures mentioned in the accessibility statement. The monitoring body is responsible for the complaint and enforcement procedure according to § 2 para. 1 BITVO M-V. At your request, it will check whether further measures are necessary with regard to the public body. The complaint and enforcement procedure is free of charge for you as the complainant. You do not need any legal assistance.

After receipt of the complaint, the following steps are carried out:

  • Examination of whether actual violations of accessibility can be determined.
  • The public body is requested to remedy the defects within a certain period. For this purpose, it receives suggestions for implementation.
  • If the public body does not comply with the complaint, it must justify this to the monitoring body.
  • All parties involved are informed about the status of the proceedings.
  • Conclusion of the enforcement procedure by a summarizing final communication to the complainant and explanation of the implementation.
  • Informing the public body and the competent technical or legal supervisory authority.

You can report your complaint via the form Complaint form according to § 14 LBGG M-V. If you would prefer to use e-mail or letter, please be sure to include your name, address, the website concerned and the reason for the complaint.

Irrespective of the complaint procedure, the enforcement procedure can also be initiated by the monitoring body for digital accessibility of public bodies M-V itself on the basis of identified deficiencies.
